6.1 Objective

6.1.1 The purpose of this Regulatory Standard (NR) is to establish the requirements for the approval, commercialization, supply and use of Personal Protective Equipment (PPE).

 

6.2 Scope of Application

6.2.1 The provisions of this NR apply to organizations that purchase PPE, workers who use it, as well as manufacturers and importers of PPE.

6.2.1.1 For the purposes of applying this NR, a legal entity established in the national territory that manufactures PPE or has it designed or manufactured, assumes responsibility for production, performance, warranty and after-sales technical assistance, and markets it under its own name or brand, shall be considered a manufacturer.

6.2.1.2 For the purposes of applying this NR, a legal entity established in the national territory that imports PPE under its own name or brand and assumes responsibility for its commercialization, performance, warranty and after-sales technical assistance, shall be considered an importer.

6.2.1.2.1 The acquirer of importation on behalf and order of third parties and the predetermined ordering party of commissioned importation provided for in national legislation shall be equivalent to an importer.

 

6.3 General Provisions

6.3.1 For the purposes of this NR, PPE is defined as an individual device or product used by the worker, designed and manufactured to provide protection against occupational risks present in the work environment, as set forth in Annex I.

6.3.2 Combined Personal Protective Equipment means any equipment used by the worker, composed of multiple devices assembled by the manufacturer to protect against one or more occupational risks existing in the work environment.

6.3.3 Requests for products not listed in Annex I to be recognized as PPE, as well as proposals for the review of those already listed, shall be evaluated by the national competent authority for occupational safety and health.

 

6.4 Commercialization and Use

6.4.1 PPE, either domestically manufactured or imported, may only be sold or used with the indication of the Approval Certificate – CA, issued by the national competent authority for occupational safety and health.

 

6.5 Responsibilities of the Organization

6.5.1 The organization shall be responsible for PPE as follows:

a) Only purchase PPE approved by the national competent authority for occupational safety and health;

b) Provide guidance and training to employees;

c) Provide employees, free of charge, with PPE suitable for the risk, in perfect condition and proper working order, in the situations set forth in subitem 1.5.5.1.2 of Regulatory Standard No. 01 (NR-01) – General Provisions and Occupational Risk Management, observing the hierarchy of prevention measures;

d) Register the supply of PPE to employees, using books, record forms or electronic systems, including biometric systems;

e) Require the use of PPE;

f) Be responsible for hygiene and periodic maintenance, when applicable, in accordance with the information provided by the manufacturer or importer;

g) Immediately replace damaged or lost PPE;

h) Report any irregularities detected to the national competent authority for occupational safety and health.

6.5.1.1 If an electronic system is adopted for PPE supply registration, it shall allow report extraction.

6.5.1.2 When the registration of disposable PPE and protective cream is not feasible, the organization shall ensure their availability in original packaging in sufficient quantity for each worker at the workplace, guaranteeing immediate supply or replacement.

6.5.1.2.1 If the original packaging is not kept, product identification information, name of manufacturer or importer, production batch, expiration date and PPE Approval Certificate number shall be made available at the supply point.

6.5.1.3 The organization may establish specific procedures for the hygiene, periodic maintenance and replacement of PPE referred to in items "f" and "g" of 6.5.1, with due information provided to the involved workers in accordance with Chapter 6.7.

6.5.2 The organization shall select PPE taking into account:

a) the activity performed;

b) the prevention measures based on identified hazards and assessed occupational risks;

c) the provisions set out in Annex I;

d) the necessary effectiveness for risk exposure control;

e) the requirements established in regulatory standards and legal provisions;

f) the suitability of the equipment for the employee and the comfort provided, according to the evaluation of the workforce;

g) compatibility in cases requiring the simultaneous use of multiple PPE, so as to ensure their respective effectiveness in protection against existing risks.

6.5.2.1 The selection of PPE must be documented and may be integrated into or referenced in the Risk Management Program – PGR.

6.5.2.1.1 Organizations exempt from preparing the PGR shall keep records specifying the activities performed and the corresponding PPE.

6.5.2.2 The selection of PPE shall be carried out by the organization with the participation of the Specialized Service in Safety Engineering and Occupational Medicine – SESMT, if existing, after consulting the employee users and the Internal Commission for Accident and Harassment Prevention – CIPA or its appointed representative.

6.5.2.3 The selection of PPE shall be reviewed under the circumstances provided in subitem 1.5.4.4.6 of NR-01, when applicable.

6.5.3 The selection, use and maintenance of PPE shall also take into account programs and regulations related to PPE.

6.5.4 The selection of PPE shall consider the use of overlying safety glasses together with corrective lenses or the adaptation of PPE, at no cost to the employee, when the employee needs visual correction in the performance of duties.

 

6.6 Responsibilities of the Worker

6.6.1 The worker shall be responsible for PPE as follows:

a) Use the PPE provided by the organization, in compliance with the provisions of item 6.5.2;

b) Use it only for its intended purpose;

c) Be responsible for cleaning, storage and preservation;

d) Notify the organization in case of loss, damage or any change that renders it unfit for use;

e) Comply with the organization's provisions on proper use.

 

6.7 Occupational Safety and Health Training and Information

6.7.1 The information and training referred to in this NR shall comply with the provisions of NR-01.

6.7.2 When providing PPE, the organization shall ensure the provision of information, in accordance with the recommendations in the instruction manual provided by the PPE manufacturer or importer, especially regarding:

a) description of the equipment and its components;

b) the occupational risk against which the PPE provides protection;

c) protection restrictions and limitations;

d) proper use and adjustment method;

e) maintenance and replacement;

f) care for cleaning, hygiene, storage and preservation.

6.7.2.1 The organization shall conduct training on the PPE to be provided when the characteristics of the PPE require it, observing the activity performed and the requirements established in regulatory standards and legal provisions.
