30.1 Objective

30.1.1 This regulatory standard and its annex set forth requirements for the protection of safety and health in waterborne work, and regulate measures to be followed by organizations and in workplaces to prevent possible physical injuries and health hazards.

 

30.2 Scope of Application

30.2.1 This standard applies to work carried out on national-flagged and foreign-flagged commercial vessels used for cargo transport, passenger transport and service provision in accordance with ratified and effective international conventions.

30.2.1.1 Workers on commercial fishing vessels shall only comply with the annex of this standard without prejudice to provisions of other regulatory standards.

30.2.2 Compliance with this regulatory standard shall not exempt entities from abiding by other general and special regulatory standards, relevant legal provisions, conventions, agreements and collective labor contracts.

30.2.3 Regulatory Standard No.10, No.13 and No.23 shall not apply to vessels classified in accordance with SOLAS Convention whose safety standards are inspected by classification societies, provided valid class certificates are presented.

 

30.3 Rights and Obligations

30.3.1 In addition to obligations specified in Item 1.4 of NR-01, employers and equivalent entities shall formally appoint and train at least one onboard regular crew member to take charge of the implementation of this standard.

30.3.2 In addition to provisions stipulated in Item 1.4 of NR-01, workers shall report detected damages and defects posing risks to personnel and vessels to duty officers or any member of Onboard Occupational Safety and Health Working Group.

 

30.4 Risk Management Program for Waterborne Work

30.4.1 Employers and equivalent entities shall formulate and implement the Risk Management Program for Waterborne Work for each vessel in accordance with NR-01 and this standard, based on actual demands and characteristics of waterborne operations.

30.4.1.2 The formulation of this program shall not exempt entities from formulating and implementing general Risk Management Program in their premises as required by NR-01.

30.4.1.2 For vessels with gross tonnage not exceeding 500, employers and equivalent entities may adopt risk assessment tools issued by Ministry of Labor and Social Security to establish the program and draw up action plans in accordance with assessment reports.

30.4.1.3 Compliance with the provisions of subitem 30.4.1.1 shall not exempt employers and equivalent entities from complying with other provisions of this standard.

30.4.2 Relevant entities shall formulate and keep the following operational procedures on board vessels:

a) Safety procedures for maintenance work on in-service vessels

b) Guidance for workers on response procedures under extreme weather conditions and work suspension rules

c) Safe access procedures for berthed and anchored vessels

d) Safe cargo handling procedures

e) Safety procedures for operations involving other vessels, ferries, offshore platforms and other marine facilities

f) Safety procedures for berthing and anchoring maneuvers

30.4.2.1 All procedures shall comply with the risk inventory and action plan of the Risk Management Program for Waterborne Work.

30.4.2.2 Procedures specified in subitem 30.4.2 shall be attached to the Risk Management Program for Waterborne Work.

30.4.3 The Risk Management Program for Waterborne Work shall be reviewed every three years, or revised in case of updates and changes in technologies, working environments, processes, conditions, procedures and work organization, or when deficiencies are found in risk assessment and preventive measures.

 

30.5 Health Protection

30.5.1 In addition to provisions of NR-07, the Occupational Health Medical Control Program shall comply with requirements of this item.

30.5.1.1 Maritime waterborne workers shall follow medical standards and health certificate templates set forth in Table III of this standard in accordance with STCW Convention, without prejudice to issuing occupational health certificates in line with NR-07 and relevant provisions herein.

30.5.2 Medical examinations include clinical examinations and supplementary examinations conducted in accordance with specifications of NR-07.

30.5.2.1 A copy of the occupational health certificate shall be kept on board in physical or electronic form.

30.5.3 If the validity period of medical examination expires during voyage, it shall be extended until the vessel berths at a port with available medical examination conditions, with a maximum extension period of forty-five days.

30.5.4 Other supplementary examinations may be arranged by the attending doctor if relevant to occupational risks identified and classified in the Risk Management Program for Waterborne Work.

30.5.5 All vessels shall be equipped with necessary first-aid supplies matching operational features, which shall be properly stored and managed by trained first-aid personnel.

30.5.6 Onboard infirmaries shall meet the following requirements:

a) Separated from other premises

b) Have proper space for storing ship medicines and medical supplies

c) Be equipped with hot and cold water supply facilities

d) Be fitted with liquid and waste drainage systems

30.5.6.1 Infirmaries shall only be used for patient medical treatment.

30.5.6.2 Infirmaries on SOLAS-compliant vessels shall additionally comply with maritime authority regulations.

30.5.7 Employers and equivalent entities shall ensure workers have access to medical institutions for:

a) Endemic disease prevention and prophylaxis

b) Vaccination administration

 

30.6 Internal Commission for Accident Prevention and Harassment Prevention

30.6.1 The commission of entities employing waterborne workers shall be composed of staff from each establishment, including waterborne workers actually serving on owned or chartered vessels, in accordance with this standard and non-conflicting provisions of NR-05.

30.6.1.1 Waterborne workers shall be represented in the commission of the establishment with the largest workforce. One full member shall be appointed for every ten vessels or fractional part thereof, and one alternate member for every twenty vessels or fractional part thereof of the entity.

30.6.2 Waterborne worker candidates for the commission shall be elected through separate voting and enjoy all rights stipulated by applicable laws.

30.6.2.1 Waterborne workers on leave are entitled to participate in elections, and the entity shall provide necessary conditions for voting.

30.6.3 Employers shall take necessary measures to ensure elected workers participate in commission meetings, including the use of electronic communication means.

30.6.3.1 Participation via electronic means shall be recorded in meeting minutes and signed by other attendees in lieu of personal signature.

30.6.4 Elected full and alternate commission members on board shall attend the monthly meeting of Onboard Occupational Safety and Health Working Group.
