29.1 Objective

29.1.1 This Regulatory Standard aims to formulate prevention measures for occupational safety and health in port work, and specify the guidelines for the implementation of occupational risk management in workplaces covered by this standard.

 

29.2 Scope of Application

29.2.1 The provisions of this standard apply to port work onboard and onshore, as well as other activities carried out in public and private ports and port facilities inside and outside the organized port area and inland port terminals.

29.2.1.1 In addition to other regulatory standards, inland port terminals shall comply with the following items of this standard:

a) 29.15 Cargo lashing and unlashing

b) 29.16 Container operations

c) 29.17 Dry bulk cargo operations

d) 29.18 Transportation, movement, storage and handling

e) 29.19 Safety in warehouses and silos

f) 29.22 Workplace lighting

g) 29.24 Refrigerated premises

h) 29.25 Sanitary and comfort conditions at workplaces

i) 29.26 First aid and other measures

j) 29.27 Dangerous goods operations, excluding item 29.27.36 and its sub-items

 

29.3 Competences and Responsibilities

29.3.1 Port operators, service hirers, employers and Labor Management Authority shall cooperate to comply with this standard and other regulatory standards on occupational safety and health.

29.3.2 Port operators and service hirers shall perform the following obligations towards casual workers:

a) Abide by and enforce this standard and other applicable legal provisions on safety and health for port work.

b) Ensure all operations are carried out after implementing preventive measures stipulated in NR-01 (General Provisions and Occupational Risk Management);

c) Conduct port operations with workers properly using personal protective equipment and comply with NR-06 (Personal Protective Equipment).

29.3.3 The Labor Management Authority shall perform the following duties for its casual workers:

a) Participate with port operators and service hirers in formulating preventive measures in accordance with NR-01;

b) Provide all workers with training on occupational safety and health in port work as specified in this standard;

c) Assign qualified workers according to risks notified by port operators or service hirers;

d) Comply with NR-06 concerning personal protective equipment;

e) Formulate and implement the Occupational Health Medical Control Program in compliance with NR-07;

f) Notify port operators or service hirers in case of any violation of this standard and other legal provisions on workers' safety and health.

29.3.4 Casual workers shall obtain qualifications through specific training provided by the Labor Management Authority or service hirers on port work safety and health regulations.

29.3.4.1 The Labor Management Authority shall provide training on occupational safety and health regulations for workers to take up posts.

29.3.4.2 The Labor Management Authority shall only assign workers to engage in activities for which they have received relevant training.

 

29.3.5 Duties of workers

a) Comply with the provisions of this standard and other applicable laws on occupational safety and health within their scope of duties;

b) Report any detected damages and defects that may pose risks to personnel or operations to the person in charge;

c) Properly use assigned safety devices, personal protective equipment and collective protective equipment as well as designated facilities.

29.3.6 Port administrations shall ensure their services comply with this standard and other general and special regulations within the scope of organized port areas.

29.3.6.1 Port administrations shall also provide adequate infrastructure to ensure safe port activities within their facilities, including facilities for emergencies specified in emergency control plans.

29.3.7 Without prejudice to the provisions herein, safety and health preventive measures for onboard port operations shall follow instructions issued by ship masters or their representatives.

29.3.7.1 Port operations can only commence after ship masters or their representatives confirm that ship equipment and accessible areas for port workers are in safe operating conditions.

29.3.8 Where services are engaged from workers' unions via contracts, agreements or collective labor conventions, liabilities specified in this standard shall be borne by the corresponding service hirer.

 

29.4 Risk Management Program

29.4.1 Port operators, service hirers and employers shall:

a) formulate and implement the Risk Management Program in accordance with NR-01 within their port facilities;

b) incorporate occupational risk information affecting port operations provided by the Labor Management Authority and port administrations related to their activities into their programs;

c) submit information on occupational risks under their administration that may affect the work of port administrations and the Labor Management Authority.

29.4.1.1 Port operators and service hirers shall include casual work activities in their Risk Management Program.

29.4.2 Port administrations shall:

a) formulate and implement the Risk Management Program in organized ports in accordance with NR-01, taking into account occupational risk information affecting port operations provided by port operators, service hirers, employers and the Labor Management Authority;

b) provide information on occupational risks affecting port operations to port operators, service hirers, employers and the Labor Management Authority.

29.4.2.1 The Risk Management Program of port administrations may formulate preventive measures for relevant entities operating within its jurisdiction, or refer to their existing programs as agreed in contracts.

29.4.3 Port operators, service hirers, employers and the Labor Management Authority may refer to the Risk Management Program formulated by port administrations in their own programs.

29.4.4 The Labor Management Authority shall:

a) formulate and implement the Risk Management Program based on occupational risk information provided by port operators, service hirers and port administrations;

b) provide occupational risk information affecting port operations to port operators, service hirers, employers and port administrations.

29.4.5 Port operators, service hirers, employers, port administrations and the Labor Management Authority may jointly formulate information exchange mechanisms stipulated in item 29.4 of this standard.

29.4.6 Port operators, service hirers and employers shall formulate the following procedures and make them accessible to workers:

a) Safe access to vessels

b) Safe transportation, movement, storage and handling of goods

c) Safety regulations for port work in vessel holds

d) Safety regulations for confined space port work in accordance with NR-33 Safety and Health in Confined Space Work

e) Safety rules for port work under adverse weather and environmental conditions, and work suspension rules when worker safety is endangered

f) Safety rules for dangerous goods operations

29.4.6.1 The above procedures shall conform to the risk inventory and action plan of the Risk Management Program.

29.4.6.2 The above procedures shall be attached to the Risk Management Program.
