22.1 Objective
22.1.1 This Regulatory Standard aims to regulate the provisions to be observed by organizations, so as to align the planning and implementation of mining activities with the continuous pursuit of workers' safety and health.
22.2 Scope of Application
22.2.1 This standard applies to organizations engaged in activities related to:
a) underground mining, including prospecting mining covered by Prospecting Mining Permit (PLG);
b) open-pit mining, including prospecting mining covered by PLG;
c) mineral processing facilities located within mining areas and PLG areas;
d) mineral exploration.
22.3 Organizational Responsibilities
22.3.1 The organization shall:
a) ensure strict compliance with this standard;
b) appoint technical persons in charge for each department;
c) suspend any activity that exposes workers to serious and imminent health and safety risks.
22.3.2 All mines and other activities specified in Clause 22.2.1 of this NR shall be under technical supervision by legally qualified professionals.
22.3.2.1 The organization shall keep physical or electronic records of technical supervision activities specified in Clause 22.3.2, including incidents, observations and proposed or implemented interventions affecting mine safety.
22.4 Occupational Risk Management
22.4.1 The organization shall implement occupational risk management in its activities preferably by workplace, in accordance with Regulatory Standard No.1 — General Provisions and Occupational Risk Management.
22.4.1.1 The occupational risk management program shall preferably be formulated by a multidisciplinary team and implemented under the responsibility of the organization.
22.4.1.2 In addition to the provisions stipulated in NR-1, the program shall cover hazards and corresponding preventive measures specified in this standard.
22.4.1.2.1 The occupational hazard identification and occupational risk assessment process specified in item 1.5.4 of NR-1 shall take the following aspects into account where applicable:
a) Explosive atmospheres;
b) Oxygen deficiency;
c) Mechanical ventilation;
d) Respiratory protection, which shall adopt the Respiratory Protection Program (PPR) issued by Fundação Jorge Duprat de Figueiredo de Segurança e Medicina do Trabalho (FUNDACENTRO) and its amendments, or other equivalent programs;
e) Hearing protection, which shall adopt the 2018 Guidelines and Minimum Parameters for the Formulation and Management of Hearing Conservation Program (PCA) issued by FUNDACENTRO and its amendments, or other equivalent programs;
f) Underwater work;
g) Stability of natural massifs and those modified or constructed by the organization;
h) Technological modification and introduction of new technologies.
22.4.2 When services are provided for the activities covered by the Scope of Application of this NR at the contractor's premises or places previously agreed in the contract, in addition to the provisions of item 1.5.8 of NR-1, the following shall be observed:
a) The contracting party and the contracted party shall carry out integrated measures to implement the preventive measures specified in this NR, aiming to protect all workers exposed to occupational risks;
b) The Risk Management Program (PGR) of the contracting party shall include preventive measures for contracted organizations or refer to the programs of the contracted parties;
c) When activities of the contracting party and the contracted party are carried out simultaneously, the contracting party shall coordinate the implementation of the preventive measures stipulated in this NR;
d) The contracting party shall provide the contracted party with information on occupational hazards and risks under its management existing in the areas where the contracted party performs its activities, as well as applicable preventive measures to be adopted where necessary.
e) Contracted organizations shall provide the contracting party with the inventory of specific occupational risks related to their activities carried out in the service areas.
22.4.3 In addition to the provisions set forth in item 1.5.7 of NR-1, the organization shall:
a) Include the occupational safety and health procedures specified in this NR in the Risk Management Program;
b) Keep the following documents on site:
I Risk inventory prepared by contracted parties, where applicable;
II Traffic circulation plan;
III Load handling plans.
22.5 Rights and Obligations of Workers
22.5.1 In addition to the provisions stipulated in NR-1, workers have the right to stop their work whenever they find evidence of serious and imminent risks to their own safety and health or that of third parties, and shall immediately report the situation to their superior who shall take appropriate measures.
22.5.2 Workers shall immediately report any situations deemed to pose risks to their own safety and health or that of third parties to their superiors.
